Acceptance of Terms

By downloading or using Odd Ones Out, you agree to be bound by these Terms of Use. If you do not agree, please do not use the app.

Who May Use the App

By using Odd Ones Out you confirm that:

• You are the owner of the device, or you are using it with the owner's permission.
• You are authorised to make any purchases you make in the app.
• You are at least 12 years old, or you are using the app in Under 12 mode with a parent or guardian's knowledge and consent.
• You give truthful information where we ask for it, and you have not previously been banned from the app.
• You are not located in a country subject to sanctions or embargoes that would make your use unlawful.

If you are under the age of digital consent where you live, a parent or guardian must agree to these terms on your behalf and must approve any purchase.

Use of the App

Odd Ones Out is a social party game intended for personal, non-commercial use. You agree to use the app only for its intended purpose — having fun with friends and family. You may not use the app to harass, harm, or offend other users.

You also agree not to: reverse-engineer, decompile, or modify the app; automate or script gameplay; access our servers by any means other than the official app or website; resell, rent, or commercially exploit the app or its content; scrape or bulk-extract our questions or content; or circumvent age gates, bans, filters, or purchase requirements.

Licence

We grant you a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use Odd Ones Out on devices you own or control, for private, non-commercial use. This licence gives you no ownership of the app or its content, and it ends automatically if these terms are terminated.

Your Profile — No Account, No Password

Odd Ones Out deliberately has no accounts and no login — no sign-up, no email, no password. Instead, your device holds a random user ID, and that ID is what identifies you to us.

Your display name, statistics, and play history are stored on our servers against that ID, as described in the Privacy Policy. Because you choose the display name yourself, use a nickname — not your real name.

The trade-off is this: there is no password to recover and nothing to sign back into, so if the user ID on your device is lost, the link between you and your profile is lost with it. That is why the next section matters — and why you should note your user ID down.

Loss of Profile, Progress or Data

Your user ID is stored on your device, so the link to your profile can be lost if you delete the app, reset or lose your device, switch phones, or restore from a backup that does not include the app's data. It may also be lost through iOS updates, device faults, or events outside our control.

We are not responsible for such loss, and we do not guarantee that any profile, statistics, progress, or unlocked content can be recovered or transferred. Keeping your own device backups is your responsibility. To the extent permitted by law, we accept no liability for data loss where you have not maintained an adequate backup.

But you can always contact us. Email oou.inquiries@gmail.com and we will look into it and see what we can do. We keep your profile record and a history of activity linked to each user ID — display name, statistics, which games were played, when, and in what mode — so if you can give us your old user ID (or enough detail about your play), we can often verify that the profile was yours and restore it. This is a best-effort courtesy, not a guaranteed service, and it depends on you giving us enough to identify the profile with confidence. Write down your user ID from the bottom of the Settings screen while you still have it.

Purchases are separate: the Spicy Pack is tied to your Apple ID, not your profile. Use Restore Purchases in Settings with the same Apple ID and it will come back — even on a new device.

Intellectual Property

All content within Odd Ones Out — including game design, artwork, questions, and code — is owned by ODD ONES OUT and protected by copyright. You may not reproduce, distribute, or create derivative works without our written permission.

Content You Provide

You are solely responsible for everything you put into the app — your display name, your answers and written entries, and any photos you choose to share in Whose Camera Roll. You confirm that you have the right to share it and that it does not infringe anyone's rights, is not unlawful, hateful, sexual, or otherwise inappropriate for the players in your room.

You keep ownership of your content. You grant us only the limited, temporary permission we need to transmit it to the other players in your session so the game can work. We do not use your content for marketing, do not publish it, and do not use it to train models. Photos exist only in server memory during a round and are deleted when it ends — see the Privacy Policy.

We may remove content and block a user ID where content breaks these rules, and we can moderate display names at our discretion.

Online Conduct

When playing online or in global matchmaking, your display name and avatar are visible to other players. You agree to:

• Choose a display name that is not offensive, discriminatory, or intended to impersonate another person.
• Treat other players with respect — harassment, hate speech, and deliberate disruption of other players' experience are not allowed.
• Not abuse the report system by submitting false or malicious reports.

We reserve the right to moderate display names and take action against accounts that violate these standards.

Fair Use and Bans

You must use Odd Ones Out fairly. You must not attempt to overload, disrupt, attack, abuse, flood, or spam the servers, exploit bugs, or otherwise interfere with the servers or with other players' experience.

Breaking these rules may result in suspension or a permanent ban without notice. Bans may be enforced by user ID and/or IP address.

If you believe a ban was a mistake, contact us at oou.inquiries@gmail.com with your user ID (found at the bottom of the Settings screen) and we will review it.

Suspension and Termination

We may suspend, restrict, or terminate your access to Odd Ones Out — in whole or in part, with or without notice — if you break these terms, if we reasonably suspect abuse, fraud, or cheating, or if we are required to do so by law. Where it is reasonable and lawful, we will tell you why, and you can appeal.

You can stop using the app at any time by deleting it. Terminating access does not entitle you to a refund of a purchase you have already made and used, except where the law requires one. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, and governing law — remain in force after termination.

In-App Purchases

Odd Ones Out offers an optional, one-time purchase ("Spicy Pack") that unlocks additional, more daring question categories intended for mature audiences. This is a non-consumable purchase — buy it once and it stays unlocked, including after reinstalling, by using Restore Purchases in Settings.

All purchases are processed by Apple through the App Store and are subject to Apple's own payment and refund terms. Prices may differ by country and may change over time; we may also run temporary offers on their own conditions. Purchases are tied to the Apple ID that made them and are not transferable between accounts.

Purchases are final and non-refundable except where required by applicable law or Apple's refund policy — refund requests should be made directly to Apple, not to us. We may reverse an unlocked purchase where a payment is charged back, fraudulent, or incomplete.

Apple and Other Third Parties

These terms are between you and us — not with Apple. Apple has no obligation to provide support for Odd Ones Out and is not responsible for the app or its content. Apple is a third-party beneficiary of these terms and may enforce them against you. Your use of the App Store is also governed by Apple's own terms.

The app relies on third-party services such as app store distribution and cloud hosting. We are not responsible for outages, changes, or failures of those services, or for the content of any third-party link.

Disclaimer of Warranties

Odd Ones Out is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the app will be error-free, uninterrupted, secure, or always available, that game rooms will stay connected, that matchmaking will find an opponent, or that any specific content or game mode will remain available. Access may be suspended for maintenance without prior notice.

Odd Ones Out is entertainment. Questions and prompts — including in games about relationships, opinions, or dilemmas — are for fun and are not advice of any kind. What you choose to share with the people in your room is your own decision.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, loss of data, loss of profile or progress, or loss of profits arising from your use of Odd Ones Out. Where we are found liable, our total liability is limited to the amount you have actually paid us for the app in the 12 months before the claim (which, for most players, is nothing).

Nothing in these terms limits liability that cannot be limited by law — including liability for intent, gross negligence, personal injury, or your mandatory rights as a consumer. If you are a consumer in the EU, your statutory rights are unaffected by this section.

We are also not responsible for the behaviour of other players, or for what other players do with content you choose to share in an online room.

Indemnity

You agree to hold us harmless from claims brought by others that arise from your misuse of the app, your breach of these terms, or content you shared through the app in violation of someone else's rights. This does not apply where the claim results from our own fault.

Changes to the Service and These Terms

We may update, modify, or discontinue any part of Odd Ones Out at any time — including individual games, categories, or online features — without prior notice.

We may also update these Terms of Use. Material changes take effect going forward, and we will revise the "Last updated" date at the top of this page. Continued use of the app after changes means you accept the updated terms. If you do not accept them, stop using the app and delete it.

Privacy

How we handle data is described in our Privacy Policy, which forms part of these terms. It explains, among other things, the play history we keep for each user ID, and the fact that we store the display name you use online — used to improve the games, prevent abuse, and help you if you lose your profile. Content rules for younger players are set out in Rules for Under 12.

Governing Law

These terms are governed by the laws of Denmark. Any disputes shall be resolved under Danish jurisdiction. If you are a consumer resident in the EU, you also keep the protection of the mandatory law of your own country and may bring proceedings there.

Complaints & Disputes

If something is wrong, talk to us first — most issues are solved by an email. Write to oou.inquiries@gmail.com describing the problem and, where relevant, your user ID, and we will review it and tell you what we can do.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to, and do not currently, participate in proceedings before a consumer arbitration board.

Severability & Entire Agreement

If any part of these terms is found invalid or unenforceable, the rest stays in force and the invalid part is replaced by the closest valid equivalent. These terms, together with the Privacy Policy and Rules for Under 12, make up the entire agreement between you and us about Odd Ones Out. We may transfer our rights and obligations under these terms to another company, for example if the app changes hands; your rights are not reduced by such a transfer.
